This is the letter drafted and sent to Terminix that there has been no response to

Dear Mr. Velarde,
Per our discussion on March 20, 2026 I am following up with this letter you requested explaining my appointment with Brett Funk that made me decide to purchase the Terminix treatments, and why we both feel the services was misrepresented; which is the reason I purchased them, and if I had known the services could not be completed as promised I would not have purchased them.
Looking back, I also feel that Mr. Funk used a bit of “scare tactic” as well as misrepresenting the product. Not only is there this matter at hand there is the months (four) we’ve dealt with scheduling, rescheduling appointments, No Shows and No responses, Excuses and now today on your last appointment your technician is saying the work cannot be completed as I promised that I paid for is exasperating consider that my spouse is undergoing treatment for cancer during this whole time, and; he has had to go into the attic in pain when he felt well enough pictures after each service showing the work was not complete each time.
This excuse is just being told this now after three and a half months! I do not understand how your salesperson would not know this and promise the whole attic, especially the area that isn’t treated he said would benefit us since it would help with the heat and cooling because more insulation would be put back on that side and would be energy efficient, and the attic fully treated throughout. I spoke to another company that does spray insulation and they do not understand
You asked me to request a refund in writing since Terminix cannot deliver what Brett Funk promised. I feel that you think I should pay for what little insulation that was sprayed into the attic, which isn’t even half of the attic and where it is sprayed it isn’t even in depth, and I was never assured the boric spray done even partly since the machine was broken. So, I am asking you what you feel I should pay for since Brett Funk and Terminix did not full fill the “energy efficient” insulation and termite resistant spray services contractual as promised; as well as the month (four) of unprofessional aggravation while my spouse is dealing with cancer, plus caused more of an energy problem with the heating and air condition with the uneven insulation and no termite treated which were the concerned area and Mr. Funk promised would be the main reason for purchasing the insulation.

You ask for a detailed description of out meeting with Brett Funk, but I think it goes way beyond that since it has taken months for your technician to come up with this excuse, which I spoke to another company and they do not understand, why nails in a beam would be a problem since all your technician can use a long hose for spraying either product should wear a hard hat (bump hat) when spraying the products. So, the excuse your technician is giving is not valid and why did it take this long to tell us and you that? Below you will find the notes on the meeting as well as the call log from phone calls starting from December to March. Text messages from everyone I reached out to during this whole time from December until March.

On December 10, 2025, Brett Funk came to my house to do my yearly inspection for subterranean termites. During our discussion before he his inspection I had asked him about Dry Wood Termites and said, “I am paranoid of termites!” He then proceeded to inspect the house and once he came down from the attic he said my fears are warranted, and showed me two dead termites in a glass vile and said “not to be worried, that there was no activity in my attic and they probably showed up through the vents and all we needed to do was a preventative treatment, the boric spray. “ So Brett, my spouse David and I sat down at the table to discuss this and he told us about the boric acid spray, which we were interested in, and he said he also told us about treated spray insulation, we told him David had cancer and we were on a tight budget with all the bills. Brett then explained how beneficial the insulation would be that it would insulate the entire house, which would lower the cost of our bills since it would help with the air conditioning, but especially with the problem I have in the back half of the house where it is cold during, especially during November through April. Insulation would fix that problem as well since the insulation would help keep the heat stay inside the house in those areas that I pointed out to him, which is the areas the Tyler said he and his technician cannot get to because of a few nails. We were promised the whole house would be insulated with protective insulation that would keep the entire house protected the energy efficient heating and cooling. That we could even write this off on our taxes since it would do the latter. This was the only reason we decided to purchase these services, and is not doing what Brett Funk promised, but the opposite since it is now the little bit of insulation has caused it to be uneven throughout.
As I said, I have included a detailed timeline with descriptions of all phone calls and text messages from beginning (December 10, 2025) to the last meeting with you and Tyler Testa on March 23, 2026. Please take inconsideration all the time I spent trying to reach your service technician, Tyler without response back, when he no showed, rescheduled last minute because machines were broken and because the service was not done correctly, and now for the fourth appointment three months later to be told it cannot be done as promised, because the areas is unreachable because of some nails in the beams. During this time my husband has been struggling with cancer and having to crawl around the attic each time, as well as us moving appointments to be here when no one even showed up or called to cancel. I can also provide the pictures we have taken on four occasions of the entire attic on: 12/12, 1/9. 1/13 and 1/23
I would have gotten this letter to you sooner, but it took me a while to compile and it’s been between doctor, scans, chemo and radiation, appointments daily through February. Now that you have read the account details of Mr. Velarde, I am asking you for a full refund for services unprovided as promised and incomplete by your technicians, who said he cannot complete it as promised, so there is nothing left to do but refund the money.

Also, I will have to have you cancel the renewable yearly treatment plan since it is something that cannot be done.
